利用規約

この規約は、SOFT-JP（以下「運営者」）が提供する Tomeoki（以下「本サービス」）の利用の条件を定めます。本サービスを使うと、この規約に同意したものとみなします。

第1条 本サービス

本サービスは、URL を保存してリストを作るブックマークとほしい物リストのサービスです。料金はかかりません。

第2条 アカウント

1. ログインには Google アカウントを使います。
2. Google アカウントを使えなくなると、ログインも書き出しもできなくなります。運営者はアカウントの復旧を行いません。ときどき書き出しておいてください。
3. アカウントは本人だけが使えます。

第3条 広告とアフィリエイト

1. 本サービスは、Amazon アソシエイト、楽天アフィリエイト、バリューコマースなどのアフィリエイトで運営しています。
2. 商品ページと公開リストにある通販サイトへのリンクには、広告であることを「（PR）」で示します。
3. 保存した URL に、ほかの人の紹介のタグが付いていても、運営者は書き換えません。

第4条 公開リストとコメント

1. 利用者が公開にしたリストと、公開の一言・コメントは、ログインなしで誰でも見られます。公開する内容には、利用者が責任を負います。
2. 運営者は、公開された内容を選んだり編集したりせず、謝礼も出しません。
3. 公開リスト・コメントに問題があるときは、通報の窓口からお知らせください。削除の申し出を受けたときは、法令に従って投稿者に照会し、対応します。明らかに違法なものは、すぐに見えなくすることがあります。

第5条 禁止すること

• 法令や公の秩序に反すること、犯罪にかかわること
• ほかの人の権利（著作権、商標権、プライバシー、名誉など）を侵すこと
• 危険なサイト（ウイルス、フィッシングなど）や違法なサイトへのリンクを公開すること
• プログラムなどで大量に保存・取得し、本サービスに負担をかけること
• ほかの人になりすますこと、ほかの人のアカウントを使うこと
• 本サービスの運営をさまたげること

運営者は、これらに当たると判断したとき、予告なく公開の停止、内容の削除、アカウントの停止をすることがあります。

第6条 データ

1. 保存したデータの権利は、利用者に残ります。
2. 利用者は、いつでもデータを書き出し、削除し、アカウントを削除できます。アカウントの削除は取り消せません。
3. 情報の扱いは、プライバシーポリシーに定めます。

第7条 変更・停止・終了

運営者は、本サービスの内容を変え、または一時的に止め、終えることがあります。終えるときは、書き出しができるよう、前もって本サービス上でお知らせします。

第8条 責任

1. 運営者は、本サービスが途切れず、誤りなく動くことを約束しません。データはご自身でも書き出して保管してください。
2. リンク先のサイトの内容、通販サイトでの取引について、運営者は責任を負いません。
3. 運営者に故意または重い過失がある場合を除き、本サービスの利用で生じた損害について、運営者は責任を負いません。消費者契約法などの法令でこの定めが無効になる場合は、その範囲で責任を負います。

第9条 規約の変更

運営者は、この規約を変えることがあります。変えるときは、変更の内容と時期を本サービス上でお知らせします。

第10条 準拠法と裁判所

この規約は日本の法律に従います。本サービスについて争いが起きたときは、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

Terms of Service

This English version is a translation provided for convenience. The Japanese version is the official text, and it prevails if the two differ.

These terms set out the conditions for using Tomeoki (the "Service") provided by SOFT-JP (the "Operator"). By using the Service, you are deemed to have agreed to these terms.

Article 1. The Service

The Service lets you save URLs and build lists, as bookmarks and wish lists. It is free of charge.

Article 2. Accounts

1. You sign in with a Google account.
2. If you can no longer use your Google account, you can neither sign in nor export your data. The Operator does not recover accounts. Please export your data from time to time.
3. An account may be used only by its owner.

Article 3. Advertising and affiliates

1. The Service is funded by affiliate programs such as Amazon Associates, Rakuten Affiliate, and ValueCommerce.
2. Links to shopping sites on product pages and public lists are marked "(PR)" to show that they are advertisements.
3. If a URL you save already carries someone else's referral tag, the Operator does not rewrite it.

Article 4. Public lists and comments

1. Lists you make public, along with their public notes and comments, can be seen by anyone without signing in. You are responsible for what you publish.
2. The Operator does not select or edit published content, and pays no reward for it.
3. If there is a problem with a public list or comment, please let us know through the report form. When we receive a request for removal, we will ask the poster and respond in accordance with the law. Clearly illegal content may be hidden immediately.

Article 5. Prohibited conduct

• Anything that violates the law or public order, or is connected with crime
• Infringing the rights of others (copyright, trademark, privacy, reputation, etc.)
• Publishing links to dangerous sites (viruses, phishing, etc.) or illegal sites
• Saving or retrieving large amounts of data by program or similar means, placing a burden on the Service
• Impersonating others, or using another person's account
• Interfering with the operation of the Service

If the Operator decides that any of the above applies, it may, without notice, stop publication, delete content, or suspend the account.

Article 6. Data

1. You keep the rights to the data you save.
2. You can export or delete your data, and delete your account, at any time. Deleting an account cannot be undone.
3. How information is handled is set out in the Privacy Policy.

Article 7. Changes, suspension, and termination

The Operator may change the Service, suspend it temporarily, or end it. Before ending it, we will give notice on the Service in advance so that you can export your data.

Article 8. Liability

1. The Operator does not promise that the Service will run without interruption or errors. Please also export and keep your own copy of your data.
2. The Operator is not responsible for the content of linked sites or for transactions on shopping sites.
3. Except in cases of intent or gross negligence by the Operator, the Operator is not liable for damage arising from use of the Service. Where laws such as the Consumer Contract Act make this provision invalid, the Operator is liable to that extent.

Article 9. Changes to these terms

The Operator may change these terms. When it does, it will announce the changes and when they take effect on the Service.

Article 10. Governing law and jurisdiction

These terms are governed by the laws of Japan. Any dispute concerning the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
